"Imperfect Victims" - Hope you have the courage to say "no"

The recently popular drama "Imperfect Victims" has a complex and tumultuous plot, sparking discussions among the public about the characters and the storyline. The story revolves around a workplace sexual assault case reported through a third-party anonymous tip: the female victim, Zhao Xun (played by Lin Yun), initially denies being harmed but reports rape five days later, accusing the suspect, Cheng Gong (played by Liu Yijun). Lin Han (played by Zhou Xun), the defense lawyer for the accused, embarks on an investigation and portrays the perspectives of the parties involved.

Yan Ming (played by Zhong Chuxi) is an upright and courageous police officer who consistently shows concern and empathy towards female victims, demonstrating a commitment to truth and fairness. Yan Ming receives Zhao Xun's report and, in the process of gathering evidence, strives to assist Zhao Xun, stating, "The significance of a rape case is not only about winning or losing in court, but also about speaking up, allowing victims the opportunity to tell their violated experiences, without criticism, being believed, and supporting each other."

 

In the past, there was the saying "a woman should please herself to be agreeable," originating from "Strategies of the Warring States: Zhao Strategy One." This phrase reflects a time when women were expected to depend on men for survival, serving as appendages to men. However, we now live in a time where we are educated from a young age about gender equality, witnessing both men and women sharing family responsibilities and collectively upholding societal functioning. Therefore, in today's context, this saying should be "a woman should please herself and be agreeable."

Whenever cases of female harassment are exposed in society, there are always people quick to judge, taking a moral high ground and asserting a "victim-blaming" attitude, directing scrutiny towards the victims: "Why was she dressed so provocatively?", "Which good girl is wandering the streets so late?", "With such heavy makeup, she doesn't look respectable"… But how many people take the time to understand the truth? Or how many truly care about what the truth is?

 

For those trapped in darkness, how do you rescue yourself?

What constitutes sexual harassment? According to Article 1010 of the Civil Code of the People's Republic of China: If a person violates another person's will and engages in sexual harassment through speech, text, images, physical actions, etc., the victim has the right to request the wrongdoer to bear civil liability under the law. The standard for determining sexual harassment is whether the actions of another person violate one's own will, causing psychological or physiological disgust.

[Legal basis: "Law of the People's Republic of China on the Protection of Women's Rights and Interests" Article 23: Injured women can report to the public security organs or file civil lawsuits with the people's courts, requesting the wrongdoer to bear civil liability in accordance with the law. Article 24: Schools shall provide physiological, psychological, and self-protection education for female students according to their age, and take measures in education, management, and facilities to enhance their awareness and abilities to prevent sexual abuse and harassment, ensuring the personal safety and mental and physical health development of female students. Schools shall establish effective systems for preventing and scientifically handling sexual abuse and harassment. Regarding illegal criminal acts of sexual abuse and harassment against female students, schools shall not conceal them and shall promptly inform the parents or other guardians of the underage female students who are victims, report to the public security organs and education administrative departments, and cooperate with relevant departments to handle them in accordance with the law. Article 25: Employers shall take the following measures to prevent and stop sexual harassment against women: (1) Formulate rules and regulations prohibiting sexual harassment; (2) Clearly define responsible agencies or individuals; (3) Conduct educational training activities for the prevention and cessation of sexual harassment; (4) Implement necessary security measures; (5) Establish complaint hotlines, mailboxes, etc., to facilitate complaint channels; (6) Establish and improve investigation and handling procedures, promptly handle disputes, protect the privacy and personal information of the parties involved; (7) Support and assist injured women in exercising their rights according to the law, and provide psychological counseling when necessary; (8) Other reasonable measures to prevent and stop sexual harassment. Article 77: If the infringement of women's legitimate rights and interests results in damage to the public interest, the prosecution authorities may issue a prosecutorial suggestion; in case of any of the following circumstances, the prosecution authorities may initiate public interest litigation in accordance with the law: (3) relevant units have not taken reasonable measures to prevent and stop sexual harassment; Article 80: In violation of this law, if a person commits sexual harassment against women, the public security organs shall criticize and educate or issue a warning, and the units to which they belong shall give disciplinary action in accordance with the law. Schools and employers that violate the provisions of this law, fail to take necessary measures to prevent and stop sexual harassment, causing infringement of women's rights or adverse social impact, shall be ordered to correct by higher authorities or competent authorities; if they refuse to correct or the circumstances are serious, the persons directly in charge and other directly responsible personnel shall be dealt with in accordance with the law.]
